How we handle personal information, written to Australian Privacy Principle standard.

Who we are

Alpha Squared Property is operated by Jamie Ryan Stone, ABN 81 766 093 847 ("we", "us", "our"). We are a buyer's agency working across Australia from New South Wales.

Jamie Stone is registered with NSW Fair Trading as an assistant agent, registration REP400068425, and operates under the supervision of the licensee in charge, Compton Estates Pty Ltd trading as Leverage Listings, licence 10034573.

This policy explains how we handle personal information. It applies to alpha2.com.au and to every dealing you have with us.

We do not ask for sensitive information as the Privacy Act defines it — health, racial or ethnic origin, political opinions, religious beliefs, sexual orientation or criminal record. Please do not send it to us.

How we collect it

Wherever we reasonably can, we collect personal information directly from you: when you book a call, fill in a form on our website, respond to an advertisement on Facebook or Instagram, email or message us, or speak with us.

We also collect information automatically when you use our website, and we may collect information about you from third parties — for example your mortgage broker, your solicitor or conveyancer, a selling agent, or a property data provider — where that is necessary to provide the service you have asked for. Where we collect your information from someone else, we will tell you unless you would already expect it.

Why we collect it

  • to work out whether we can help you, and discuss your brief
  • to research, shortlist, inspect, evaluate and negotiate property on your behalf
  • to prepare and administer agreements, and communicate with the other professionals in your transaction
  • to arrange verification of your identity and meet our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 and its Rules
  • to meet our obligations under the Property and Stock Agents Act 2002 (NSW) and equivalent legislation in other states
  • to send you market research, reports and other marketing you have not opted out of
  • to measure and improve our advertising and our website
  • to respond to your questions and handle complaints

If you do not give us the information we ask for, we may not be able to act for you. We do not sell personal information, and we do not disclose it to anyone for their own marketing.

Who we share it with

  • Compton Estates Pty Ltd t/a Leverage Listings, our licensee in charge, who supervises our work and executes agency agreements
  • the other professionals in your transaction — selling agents, your broker, your solicitor or conveyancer, building and pest inspectors, property managers — and only what each of them needs
  • PEXA AML Pty Ltd trading as PEXA Clear, who verify your identity where the law requires it before we act for you. You upload your identification to them directly; we receive the result of the check, not your documents
  • our other service providers, listed below
  • government agencies and regulators where the law requires it, including AUSTRAC and NSW Fair Trading

Overseas disclosure

Some of the software we use stores information outside Australia. By giving us your information you accept that it may be held in these countries, which do not have privacy laws equivalent to Australia's.

PEXA AML Pty Ltd trading as PEXA Clear, who verify identity, is an Australian company.

We also use contractors, who may be located overseas, to maintain our systems. They are given the minimum access they need and are bound to keep your information confidential. We take reasonable steps to ensure these providers handle your information consistently with the Australian Privacy Principles.

Our website uses cookies and similar tools so that it works properly and so we can measure our advertising.

Our typefaces are served from our own site, not from a font service, so loading a page does not tell any third party that you visited.

You can block or delete cookies in your browser settings. Some parts of the site may not work as well if you do. You can also limit advertising tracking in your Facebook, Instagram and Google account settings, and through your device's privacy controls.

Marketing and opting out

If you have given us your details or been in touch about our services, we may send you market research, our quarterly screen report and other material about what we do.

Every marketing email carries an unsubscribe link, and we act on it within five working days as the Spam Act 2003 requires. You can also reply to any message, or email admin@alpha2.com.au, and ask us to stop. We will still send you messages we need to send about a service you have engaged us for.

Security and how long we keep it

Your information is held in the cloud services listed above, protected by access controls and multi-factor authentication. Jamie Stone has access to it. Our licensee in charge and our contractors have access where their role requires it.

Your identity documents are an exception. You upload them to our verification provider directly. Neither we nor our licensee sees them at any point — we receive only the outcome of the check.

No system is completely secure. If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme requires.

  • Identity verification and transaction records: seven years, as the AML/CTF Act requires. Where a verification provider carries out the check, the record of it is still kept for that period
  • Agency and client records: three years, as NSW property legislation requires
  • Enquiries that did not become engagements: until you ask us to delete them, or until they are no longer useful

When we no longer need information and are not required to keep it, we destroy it or de-identify it.

Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, and you can ask us to correct anything that is wrong or out of date. Email admin@alpha2.com.au.

We will respond within 30 days. There is no charge to make a request, although we may charge a reasonable amount for the work of supplying a large amount of information, and we will tell you before we do.

We may refuse access in the limited circumstances the Privacy Act allows — for example where giving it to you would unreasonably affect someone else's privacy. If we refuse, we will tell you why in writing and how to complain.

Complaints

If you think we have mishandled your personal information, email admin@alpha2.com.au with the details. We will acknowledge your complaint within five working days and respond within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

Complaints about our conduct as a property agent can also be made to NSW Fair Trading, or to the licensee in charge, Compton Estates Pty Ltd t/a Leverage Listings.

Changes to this policy

We update this policy from time to time. The current version is always at alpha2.com.au/privacy, and the date below tells you when it last changed.
